1. OVERVIEW AND ACCEPTANCE

TopHouse Network LLC (“TopHouse,” “we,” “us,” or “our”) operates the website located at jointophouse.com (the “Site”). By accessing the Site, purchasing products, downloading digital content, or using our community features (“FratChat”), you agree to be bound by these Terms of Service (“Terms”).

If you do not agree to all of these Terms, do not use this Site.

2. OUR BUSINESS MODEL (The “Hybrid Platform”)

It is important that you understand how TopHouse operates. We function in three distinct capacities:

1. Retailer: We sell physical goods directly to you (e.g., party supplies, decor).

2. Digital Publisher: We sell downloadable content, guides, and blueprints.

3. Booking Platform/Connector: We facilitate introductions and bookings between you and third-party vendors for services such as equipment rentals, custom apparel, and event production.

3. ELIGIBILITY

You must be at least 18 years old to use this Site. By agreeing to these Terms, you represent that you are at least the age of majority in your state or province of residence. If you are using the Site on behalf of an organization (e.g., a Fraternity Chapter), you represent that you have the authority to bind that organization to these Terms.

4. PRODUCT TERMS: PHYSICAL GOODS

4.1. Shipping & Fulfillment Many of our products are fulfilled via third-party suppliers or drop-shipping partners. Shipping times provided on the Site are estimates only. TopHouse is not liable for shipping delays, lost packages, or damage caused by the carrier. Risk of loss passes to you upon our delivery of the item to the carrier.

4.2. Returns & Refunds Physical products are subject to our [Return Policy]. Please note that custom items (e.g., custom flags, printed apparel) are generally non-refundable unless defective.

4.3. Product Descriptions We strive to be accurate, but we do not warrant that product descriptions or other content are error-free. If a product is not as described, your sole remedy is to return it in unused condition.

5. PRODUCT TERMS: DIGITAL PRODUCTS & BLUEPRINTS

5.1. No Refunds on Digital Goods Due to the nature of digital data, all sales of downloadable content (e.g., "Event Blueprints," "Dye Tournament Guides," "Playlists") are final and non-refundable.

5.2. License to Use When you purchase a Blueprint or Guide, you are granted a limited, non-exclusive, non-transferable license to use the materials for your personal or individual chapter use.

  • You MAY: Print copies for your planning committee.
  • You MAY NOT: Resell, redistribute, upload to public forums, or share these files with other chapters or organizations. Doing so is a violation of our Intellectual Property rights.

5.3. No Guarantee of Results Our Blueprints are planning aids based on successful past events. TopHouse does not guarantee that your event will be profitable, well-attended, or successful. You are responsible for the execution.

6. THIRD-PARTY SERVICES & RENTALS (The “Connector” Clause)

6.1. Role of TopHouse For services such as stage rentals, audio/visual production, or large-scale custom orders, TopHouse acts solely as a connector or booking agent. We introduce you to third-party vendors ("Vendors").

6.2. Contract is with the Vendor When you book a service through us, your ultimate contract for performance is with the Vendor, not TopHouse. TopHouse is not responsible for the Vendor’s performance, safety protocols, insurance coverage, or failure to show up.

6.3. Release of Liability You explicitly release TopHouse from any claims, damages, or disputes arising from your interaction with these third-party Vendors. Any issues regarding the service (e.g., "The stage was late") must be resolved directly with the Vendor.

7. SAFETY, COMPLIANCE & PROHIBITED USE

7.1. Compliance with Laws You agree to comply with all local, state, and federal laws, as well as University and National Fraternity/Sorority policies, when using our products or plans.

7.2. Alcohol & Drugs TopHouse sells party supplies and barware. We do not sell alcohol. You acknowledge that:

  • You must be of legal drinking age to purchase alcohol-related accessories.
  • TopHouse is not liable for any personal injury, death, or property damage resulting from the consumption of alcohol in conjunction with our products (e.g., using a funnel or dispenser).
  • We strictly prohibit the use of our products for hazing.

7.3. No Hazing Policy TopHouse condemns hazing in all forms. You agree not to use any product, blueprint, or service purchased from us to facilitate hazing, forced consumption, or any activity that endangers the physical or mental health of any student.

8. FRATCHAT & USER GENERATED CONTENT

8.1. User Responsibility TopHouse may provide forums ("FratChat") for discussion. You are solely responsible for the content you post. TopHouse does not endorse any user opinions.

8.2. Prohibited Content You may not post content that:

  • Is illegal, threatening, or defamatory.
  • Promotes hazing or sexual violence.
  • Infringes on the intellectual property of others.
  • Doxxes or reveals private information of others.

8.3. Section 230 Notice As a provider of an interactive computer service, TopHouse is protected under Section 230 of the Communications Decency Act. We are not the publisher or speaker of any information provided by another information content provider.

8.4. Moderation We have the right, but not the obligation, to monitor and remove any content at our sole discretion.

9. DISCLAIMER OF WARRANTIES

THE SITE, PRODUCTS, AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

TOPHOUSE DOES NOT WARRANT THAT THE USE OF OUR BLUEPRINTS WILL RESULT IN A SAFE OR SUCCESSFUL EVENT. YOU ASSUME ALL RISK ASSOCIATED WITH HOSTING EVENTS.

10. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, TOPHOUSE NETWORK LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING:

1. PERSONAL INJURY OR DEATH ARISING FROM EVENTS PLANNED USING OUR GUIDES OR EQUIPMENT BOUGHT/RENTED THROUGH US.

2. PROPERTY DAMAGE TO CHAPTER HOUSES OR VENUES.

3. LEGAL FINES INCURRED BY YOUR CHAPTER FOR NOISE VIOLATIONS, ALCOHOL INFRACTIONS, OR UNIVERSITY SANCTIONS.

IN NO EVENT SHALL TOPHOUSE’S AGGREGATE LIABILITY EXCEED THE AMOUNT YOU PAID TO TOPHOUSE FOR THE SPECIFIC PRODUCT OR SERVICE GIVING RISE TO THE CLAIM.

11. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless TopHouse, its officers, directors, employees, and partners from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of:

  • Your breach of these Terms.
  • Your violation of any law or the rights of a third party.
  • Any bodily injury, death, or property damage occurring at an event associated with TopHouse products or services.

12. DISPUTE RESOLUTION

12.1. Governing Law These Terms shall be governed by the laws of the State of Texas, without regard to its conflict of law provisions.

12.2. Binding Arbitration Any dispute arising from these Terms or your use of the Site shall be resolved through binding arbitration in Austin, Texas. You waive your right to a trial by jury or to participate in a class action lawsuit.

13. CHANGES TO TERMS

We reserve the right to update these Terms at any time. Changes will be effective immediately upon posting to the Site. Your continued use of the Site constitutes acceptance of the new Terms.
